Rape seen through iPhone

AN UNSUSPECTING victim of criminal sexual conduct discovered that she was raped after seeing still photos and videos of the alleged crime recorded by her alleged abuser.

A man has been arrested and charged with two counts of third-degree criminal sexual conduct as a second-degree felony.

The victim filed a complaint against the man and told police officers that she and the defendant switched their phones as previously agreed. When checking the iPhone 4 to see if the defendant had deleted his personal information and contacts, she came across photos and videos of the defendant having sexual intercourse with her, digitally penetrating her and fondling her while she was highly intoxicated and passed out.

The victim said the incident likely occurred around April 26 or 28 when she and the defendant attended a gathering. She remembered that she was intoxicated and she vomited during the occasion but she had no idea she was sexually assaulted by the defendant until she saw the photos and videos. The victim said she confronted the defendant who admitted that he had sex with her while she was asleep.

The defendant apologized.

Police viewed the photographs and videos on the iPhone and officers noted there were some photos where the acts appeared to be consensual, but that the majority of the pictures showed the victim to be unresponsive and asleep.

One voice recording was also reviewed by the police. The volume was low but the officer was able to make out some of the conversation wherein the defendant was apologizing for violating the victim and appeared to be crying.
