DOCOMO Guam Holdings and MCV Guam Holdings are seeking the Federal Communications Commission’s speedy approval of their acquisition agreement, noting that no party is opposed to the proposed deal.
“The instant transfer will produce benefits for the people of Guam and the CNMI and will result in no competitive harm,” Docomo and MCV said in their reply comments filed with FCC last week.
“The lack of opposition is unsurprising: The applications demonstrate that the transfer of control will promote the public interest by allowing Docomo Guam – through its parent company, NTT Docomo Inc. – to bring its telecommunications expertise, management resources, and financial stability to MCV’s operations in Guam and the CNMI, and that the transaction will not result in any competitive harm,” they added.
On the home front, the Public Utilities Commission will conduct a public hearing at 6 p.m. tonight at the GCIC Building in Hagåtña to receive testimony on the proposed transfer of MCV to Docomo and evaluate public interest in the issue.
The PUC said the hearing will determine if the proposed acquisition “satisfies the requirements for granting a certificate of authority” and “whether the applicant possesses sufficient technical, financial, and managerial resources and abilities to provide telecommunications services in Guam.”
The agreement signed in August involves Docomo Pacific’s full purchase of MCV’s stock.
The Washington-based technology groups One Economy Corp. and One Global Economy have endorsed the proposed union, which they said would bring better telecommunication services at lower costs to Guam and the CNMI.
Public interest
“One Economy's comments are further, and compelling, evidence that the proposed transaction is in the public interest,” Docomo and MCV said. “Its comments support the commission’s speedy approval of the license transfers.”
The U.S. Department of Justice has asked the FCC to delay action on the petition pending completion of the federal evaluation on any “national security, law enforcement, and public safety issues.”
“Docomo Guam is committed to satisfying any issues raised by Team Telecom,” Docomo and MCV said.
They noted that Docomo Guam signed a security agreement when it purchased Guam Cellular and Paging Inc. in 2006. “Docomo Guam has affirmed that the commitments and undertakings in the agreement will continue to be binding after the proposed transfer of control that is the subject of the instant applications,” they said in the reply comments.
