Adelup will settle tax case for $100K

THE Governor’s Office is inclined to take an amount of between $100,000 and $300,000 to settle the government’s claim against a couple who allegedly owed nearly $3.7 million in unpaid taxes plus penalties, according to a highly reliable source.

“This is ridiculous. We worked hard on that case and Adelup is just giving it away,” the source told Variety. “If we recovered that money, the [government of Guam] would have cash to pay the tax refunds.”

Arthur Clark, advisor to Gov. Eddie Calvo, is now officially representing the Governor’s Office in the settlement negotiation with Dennis and Asuncion Rodriguez, following the federal court’s order yesterday granting the motion by the Attorney General's Office to withdraw from the case.

The AGO backed out of the tax case due to a disagreement with Adelup on how to proceed with the case. The Rodriguezes are the parents of Democratic Sen. Dennis Rodriguez Jr.

In a motion earlier filed with the federal court, Assistant Attorney General David Highsmith said Clark had begun negotiating with the Rodriguezes on behalf of the governor even before the AGO was handling the case.

The AGO was opposed to Clark’s settlement proposal, saying such an option was “repugnant,” “legally inadvisable” and “antithetical to the public interest.”

“I don’t know what’s going on in Adelup,” the source said. “Under the Organic Act, the Attorney General is the chief legal officer of Guam. They just decided they wanted to take over the case which started as a criminal case.”

As of press time, the Governor’s Office had not responded to Variety’s request for comment.

In June, the AGO sought a summary judgment asking the federal court to authorize the government to foreclose on the property of the Rodriguez couple, who allegedly owed $2.7 million in unpaid taxes from 1996 to 2001 plus $950,903 in accrued interests and penalties.

Nita, you obviously don't pay income taxes, nor, obviously, do you rely on the Retirement Fund, which Carl is ripping off (in contravention of 2 GCA 1120(b) and 1 GCA 720) to the tune of approximately $30,000 a year. Otherwise, I guarantee your attitude would be, "I pay taxes, why shouldn't they?" Your mindless synchopancy is a luxury most of us can't afford, because we do have skin in the game. In truth, Carl TC is the only game in town for you, isn't he? You think going onto this space and accusing me and others of corruption shows your obeisance to Carl, right?. Maybe you think he will throw you a few crumbs in recognition of your slavish devotion.
This scandal is a golden opportunity for Carl, an opportunity I don't see him passing up. After unsuccessfully trying to trump up corruption charges against Pepsi and Feckless Felix arising out of the FY2011 40% increase in health insurance premiums, he will not hesitate to exploit this scandal-a genuine scandal.

Nita, you are right this is crook Guthry, he is also famous with the blue houses in Angeles and Burgos street in Manila. You can find him around with the little ones, spending your tax dollars.

If they owe $100K in taxes, then force them to pay $100K but also include 1 year of jail time for every year they were late in paying their taxes. This would be a good example to the rest of the Ladrones.

Who do you want ot take us seriously, the USA and Wall street? The crooks over there steal by the BILLIONS. Calvo knew from the outset that when the republicans went after the Rodriquezes, it was political. Calvo is now trying to RIGHT the wrong inflicted on the Rodriquezes. When you remove the penalties, I'm sure they only owe $100k. Ninety nine per cent of all penalties imposed by Rev & Tax were removed after a settlement is reached. Moylan, Brooks and Camacho improperly did this to the Rodriquezes.

On the other hand, that specific case was engineered by the Republicans in order to hurt Rodriguez.

Initial 80,000 Dollars taxes owed have mushroomed under the cooperation of the Ag's office (Moylan) our famous fraud Public Auditor (Doris Brooks) and of course the cooperation of Rev and Tax.

You apply the penalties and percentages on 80k over all these years and voila you got millions, but the parties involved know that this was just another political vendetta.

Why don't you collect unpaid taxes from some notorious Republicans, which are in this administration right now?

Pepsi and Clark are above the law and they take on that case by themselves.

Calm down people. None of you know the real story. first of all remember that this was a vengeful act of doug Moylan and Felix Camacho. The power of the AG's office and the over-broad authority of Rev & Tax is where the problem lies. Obviously the district court feels that although Rev & Tax imposed the penalties and interests, they feel that a just settlement to this case would be for the parties to negotiate. The AG and their over-zealous prosecutors were not about to budge. Good that the governor stepped in. I believe that had the court not suggested a settlement negotiation the governor would have left the matter to the AG. "Shades" of over-zealous prosecution that the AG's office perpetrated against the former governor. Let's bring back the appointed AG. That place has become another layer of political beauracracy.
