GUAM Animals In Need (GAIN) Vice President Valerie J. Bock released a statement yesterday in response to the lawsuit filed by Assistant U.S. Attorney Karon Johnson against the organization.
“GAIN’s position is this lawsuit is frivolous and has no merit. Karon Johnson has a history within the organization of conflict and chaos. Her conduct has been perceived to be hostile against GAIN’s mission and goals,” Bock said.
“It is unfortunate that a public servant, an assistant U.S. attorney, wishes to pursue a meritless action against a nonprofit whose purpose is to help the island’s animal population,” she added.
According to Bock, Johnson was not a founding member or incorporator of GAIN. The organization, she said, was started by Rebecca Rodriguez, formerly Tomzik, at the time incorporation papers were filed and received at the Department of Revenue and Taxation in Nov. 28, 1989.
Johnson recently filed a lawsuit against GAIN after the nonprofit organization’s board of directors refused to renew her membership, which is set to expire on Aug. 24.
According to court documents, Johnson is “petitioning the court to issue its preliminary and permanent injunctions prohibiting GAIN from stripping or otherwise denying her right to participate as a member in good standing from GAIN.”
Furthermore, according to court documents, Johnson “seeks declaratory judgment from the court that the corporate bylaws of GAIN, upon which GAIN’S board of directors have relied in attempting to strip Johnson of her status as a member of good standing, be declared invalid on the ground that they are vague, ambiguous, and fail to give notice of prohibited conduct.”
Johnson is represented by Atty. Robert P. Kutz in the case. Kutz previously served as GAIN’s legal counsel for 12 years but is no longer representing the nonprofit organization.

That makes a big difference.

Do not let this frivolous lawsuit or Karon's use - excuse me - misuse of her power - stop you.
Remember, this will always look bad for Limtiaco for letting her people do this and bully themselves on you.
It is about time GAIn changed, and with Karon gone it can only be for the better.
