A WOMAN found guilty of perjury in an alleged marriage fraud case in federal court was sentenced to serve 12 months minus one day in prison, but has yet to go behind bars pending an appeal to the Ninth Circuit Court.

Ji Eon Lee and husband Melvin Douglas Davis were indicted in December 2009 in the District Court of Guam on charges of marriage fraud, perjury, and false statements. Although Davis was found not guilty of the charges, Lee was found guilty of one count of perjury by a jury.

Lee was sentenced Friday by Chief Judge Frances Tydingco-Gatewood to imprisonment of one year minus one day, plus three years of supervised release. However, according to the court order, Lee remains on release pending an appeal of her case. Should the conviction be upheld by the Ninth Circuit, the order stated, she shall surrender to the U.S. Marshal.
