In response to Rebecca Rodriguez's Letter to the Editor on Guam Animals In Need (GAIN) lawsuit (8.21.2012):
REBECCA Rodriguez left Guam 21 years ago, and her memory does not serve her correctly. She had initially filed Articles of Incorporation, signed by herself and five others, on Nov. 28, 1989. I joined GAIN in February 1990 and became the membership chair. I think Rebecca has forgotten that we had been aggressively fundraising for several months, representing that GAIN was a public charitable corporation, when we received a letter from the Department of Revenue and Taxation, to the effect that our Articles of Incorporation had NOT been accepted, and that in fact GAIN was NOT a registered Guam charitable corporation. I clearly remember our consternation when we received this notice, because it meant we had been misrepresenting our status and – in theory – we should return all the money we had collected.
I corrected the problem, we re-incorporated GAIN under four incorporators: Rebecca, Marie Chenery, Tambra Maddock and myself. We signed the Articles in front of a notary on Sept. 10, 1990, and I personally took them to Rev&Tax. At my request, the director agreed to allow us to keep the original filing date so no one could say we had been misrepresenting our status.
I’m easy to find in the phone book. Why would Rebecca call me a liar based on her recollection of something that happened 22 years ago, rather than just give me a call?
Because Rebecca hasn’t been involved in GAIN for 21 years, she doesn’t know what’s happened to the organization since Marie Chenery left. Our president left Guam eight months ago but refuses to resign; the board has exhausted our savings; we no longer publish a newsletter; GAIN has abandoned its wellness clinics and spay/neuter program; and we’ve even let our Petfinder membership expire. In 2011, the shelter took in 6,459 cats and dogs, and had to euthanize 5,452. Yet, as of today, if a newcomer to Guam logs into Petfinder and types in “Guam,” the nearest animal shelter is listed in Hawaii! I think this is disgraceful.
I was a member in good standing and chair of the legislation committee, until July when I announced my candidacy for the board. I am running for the board because I believe we could be doing so much more to reduce euthanasia rates at the shelter. During the two weeks I was off-island, the board voted not to renew my membership, thereby making me ineligible to run for office. I’ve had to bring a lawsuit to reinstate my membership so I can present my platform to the other members. The idea – that a charitable board can control the candidates for a board election by canceling the membership of people it doesn’t like – is repugnant to our democratic system.

I was on island two years ago and what I found was a progressive organization with forward-thinking programs, a clean shelter and people actually adopting animals. I also found a community of veterinarians who liked and supported GAIN. All of this was being helmed by exceptional individuals who made the difficult decision to place certain programs on hold when the money ran low. These are hard times for everyone and responsible, non-profit groups everywhere are doing the same thing. And people donate to an animal group expecting that their money will be spent on the animals. SPENT – that is the key word here. If an organization sits on funds while animals suffer – they have failed to do their job.
So what is Ms. Johnson doing to be part of the solution? Is she fund-raising for GAIN so they can get their programs going again? Is she taking on the responsibility of getting PetFinder reactivated and maintaining it so more animals can be adopted? No. She’s spending her time, time that could go to help the animals, on suing GAIN. Her behavior is the only thing that is repugnant here.

Ms. Johnson is correct, I have no memory of this but here is what I do remember. Ms. Johnson was not there when I was begging people to be on the board so I could start the organization. She was not there at the first dog wash we held. She was not present at the first education fair that we participated in, nor was she there the first day that GAIN visited the shelter and found animals starving and eating one another. And she was still not there when GAIN was fighting tooth and nail to start the volunteer program at the shelter. No matter how many claims she’d like to make or how many problems she solved along the way, she is NOT and NEVER WILL BE a founder of GAIN. A “founder” is somebody who establishes an institution, business or organization. She established nothing. To claim anything else, is an attempt to rewrite history.
I didn’t call Ms. Johnson because I have no interest in speaking to her. 20+ years ago she was more a part of the problem than the solution. She was always disrespectful to the shelter workers and created ill feelings on behalf of the organization, that myself and others had to clean up after. And even with all the time that has past and the distance that lies between me and Guam – I still know the sound of her music.
Treat me kindly, my beloved master, for no heart in all the world is more grateful for kindness than the loving heart of me.
Speak to me often, for your voice is the world's sweetest music, as you must know by the fierce wagging of my tail when your footstep falls upon my waiting ear.
When it is cold and wet, please take me inside... for I am now a domesticated animal, no longer used to bitter elements... and I ask no greater glory than the privilege of sitting at your feet beside the hearth... though had you no home, I would rather follow you through ice and snow than rest upon the softest pillow in the warmest home in all the land... for you are my god... and I am your devoted worshiper.
Keep my pan filled with fresh water, for although I should not reproach you were it dry, I cannot tell you when I suffer thirst. Feed me clean food, that I may stay well, to romp and play and do your bidding, to walk by your side, and stand ready, willing and able to protect you with my life, should your life be in danger.
And, beloved master, should the Great Master see fit to deprive me of my health or sight, do not turn me away from you. Rather hold me gently in your arms as skilled hands grant me the merciful boon of eternal rest...and I will leave you knowing with the last breath I drew, my fate was ever safest in your hands.
